Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the MindStash mobile application ("App") operated by Bliss Technologies LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

MindStash is a content organization application that allows users to save links, create notes, organize content in folders, and generate AI-powered summaries. The App is available for iOS devices.

3. User Accounts

Account Creation

To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Age Requirements

You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you meet this requirement.

4. Subscription and Payments

Free Tier

MindStash offers a free tier with limited AI tokens and access to core features. Free users receive a one-time allocation of 10 AI tokens.

Pro Subscription

The Pro subscription is available for $4/month or $25/year and includes unlimited AI summaries, automated content organization, and priority support.

Billing

Subscriptions are billed in advance on a monthly or annual basis. Payment is processed through Apple's App Store. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

Cancellation

You may cancel your subscription at any time through your App Store account settings. Cancellation will take effect at the end of the current billing period, and you will retain access to Pro features until then.

5. Acceptable Use

You agree not to use the App to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Upload malicious code or attempt to compromise the App's security
  • Harass, abuse, or harm other users
  • Store or share illegal content
  • Attempt to reverse engineer or decompile the App
  • Use automated systems to access the App without permission
  • Resell or redistribute the App or its features

6. AI Usage and Content

AI-Generated Content

MindStash uses artificial intelligence (via OpenAI) to generate content summaries. AI-generated summaries are provided for convenience and may not always be accurate or complete. You should not rely solely on AI summaries for critical decisions.

Content Processing

When you request an AI summary, your saved content is sent to third-party AI services for processing. By using this feature, you consent to this data processing.

Your Content

You retain ownership of any content you save or create in MindStash. By using the App, you grant us a limited license to store, process, and display your content as necessary to provide the service.

7. Intellectual Property

The App, including its design, features, code, and content (excluding user content), is owned by Bliss Technologies LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express permission.

8. Third-Party Services

The App may contain links to or integrations with third-party websites and services. We are not responsible for the content, privacy practices, or terms of service of any third parties. Your use of third-party services is at your own risk.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or secure, or that any defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLISS TECHNOLOGIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bliss Technologies LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms in the App or on our website. Your continued use of the App after such changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If a dispute cannot be resolved informally, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
